Imagineer announced that the company won a second trial in the Spanish Commercial Courts of Alicante regarding a lawsuit concerning trademark infringement of the Medabots international name in the European territory (known as Medarot in Japan). The Courts recognized that the use of the Medabots name by Kevin Comadrán de Frutos infringes Imagineer’s intellectual property rights. The latest court decision is not yet final and an appeal may be filed.
The case concerns a lawsuit filed back in May 26, 2020 by Kevin Comadrán de Frutos, a Spaniard citizen residing in Andorra, and who is not associated to Imagineer. Comadrán registered the Medabots name on February 2018 to launch his own NFT game project.
Comadrán then sued Imagineer at the Commercial Court of Alicante in Spain under the claim that the company was infringing on his trademark rights, and with the intention of stopping Imagineer from distributing and marketing games with the Medabots name in Europe. The EU Trademark Court initially ruled in favor of Comadrán on July 15, 2020.
The same Court dismissed Comadrán’s claim on November 29, 2021, and ordered a cancelation of the EU trademark. On February 23, 2022, Imagineer received an appeal from Comadrán against the Court’s decision, but was recently dismissed on September 15, 2023.
Imagineer will issue a press release once a final decision has been reached. The company also claimed that even in the case of an appeal, it will continue to take action towards Comadrán’s lawsuit and bad faith use of the Medabots name in the European territory.
